Terms of Service

The agreement between you and HomeWealthNow. Please read it before using the site or submitting a form.

Please read: arbitration and class action waiver

Section 17 contains a binding arbitration agreement and a class action waiver. It affects how disputes between you and HomeWealthNow are resolved. If it applies to you, most disputes will be decided by a neutral arbitrator rather than in court, and you give up your right to a jury trial and to participate in a class action.

You have 30 days to opt out. If you do not want to be bound by the arbitration agreement, you may opt out by following the instructions in Section 17.6. Opting out will not affect your use of the site or our services in any way.

1. Acceptance of these terms

These Terms of Service ("Terms") form a legally binding agreement between you and HomeWealthNow ("we," "our," "us," or the "Company") governing your use of HomeWealthNow.com (the "Site") and our services.

You accept these Terms by doing any of the following: using the Site, submitting a form, chatting with our AI assistant, calling us at 678-866-1955 or 404-400-7884, or otherwise using our services.

If you do not agree to these Terms, do not use the Site or our services.

1.1 Electronic agreements

You consent to receive communications and to enter into agreements with us electronically. You agree that your electronic submissions, including clicking a submit button or providing consent through a form, constitute your signature and have the same legal effect as a handwritten signature. You may withdraw this consent by contacting us, though doing so may prevent us from providing our services.

2. Who may use the site

By using the Site, you represent and warrant that:

  • You are at least 18 years of age and have legal capacity to enter into a binding agreement.
  • You are located in and a resident of the United States. The Site is not directed to users outside the United States.
  • All information you provide is accurate, current, and complete, and you will keep it accurate.
  • You are using the Site for lawful purposes only.
  • If you are submitting information on behalf of another person, you have that person's authorization to do so and to consent to contact on their behalf.

Being eligible to use the Site is not the same as being eligible for any product. FHA-insured reverse mortgages generally require a borrower aged 62 or older. Final expense insurance products have their own age ranges and state availability.

3. What we do, and what we are not

HomeWealthNow is an independent marketing and lead referral service. We provide:

  • Educational content about reverse mortgages, home equity conversion mortgages (HECMs), and final expense insurance.
  • Referral services connecting homeowners aged 62 and older with licensed reverse mortgage lenders, and connecting consumers with licensed insurance agents.
  • Free guides and materials.
  • Phone, email, text, and chat support.

What we are not

We are not a lender or mortgage broker. We do not originate, underwrite, fund, or service reverse mortgage loans, and we make no credit decisions.

We are not an insurance company. We do not issue policies, underwrite coverage, set premiums, or make coverage decisions.

We are not affiliated with any government agency. We are not affiliated with, endorsed by, or acting on behalf of HUD, the FHA, or any other government agency.

4. How the referral works

When you submit information to us, we share it with one or more licensed lenders, insurance agents, or other partners so they can contact you about the products you inquired about. By submitting information, you authorize us to do this.

4.1 Compensation

We receive compensation from our partners for qualified referrals. That compensation is how our service remains free to you.

You should understand what that means. Compensation arrangements may influence which partners we work with, which partners appear on this Site, and the order in which they appear. We do not represent that our referrals reflect a survey of all available lenders, agents, carriers, or products, or that a partner we refer you to offers the best available rate, premium, or terms.

We encourage you to compare offers from more than one lender or agent before you commit to anything.

4.2 No guarantee of any outcome

We make no guarantee that you will be contacted by any particular partner, that you will qualify for any product, or as to any rate, premium, coverage amount, loan amount, term, or timeline you may be offered. All of those are determined by the lender, agent, or carrier, not by us.

5. Contact consent

5.1 Phone calls

By providing your telephone number on a form, in a chat, or by calling us, you expressly consent to receive telephone calls from HomeWealthNow and our lending and insurance partners at that number, including calls made using an automatic telephone dialing system, an artificial or prerecorded voice, or an AI-generated voice, and including calls to a wireless number that may result in charges to you.

You acknowledge that:

  • Consent is not a condition of purchasing any goods or services.
  • You may revoke consent at any time by any reasonable method, including telling the caller, calling 678-866-1955, or emailing [email protected].
  • Standard telephone and data rates may apply.

5.2 Text messages

If you provide your mobile number and consent to text messaging, you provide express written consent to receive automated marketing and informational text messages from HomeWealthNow and our partners at that number.

  • Message frequency varies. Message and data rates may apply.
  • Consent is not a condition of purchase or of receiving any service.
  • Reply STOP to opt out. Reply HELP for help.
  • Carriers are not liable for delayed or undelivered messages.

5.3 Email

By providing your email address, you consent to receive educational, transactional, and marketing emails from us and our partners. You may unsubscribe from marketing emails at any time using the link in any message or by contacting us.

5.4 Withdrawing consent

Withdrawing consent stops future contact from us. If we have already referred you to a partner, you must contact that partner separately to stop their communications. See our Privacy Policy for details.

6. AI assistant terms

The Site provides an automated artificial intelligence assistant identified as "Sarah."

6.1 It is software, not a person

Sarah is software. Sarah is not a human being, not an employee, not a licensed loan officer, and not a licensed insurance agent. Any name, image, or conversational style used by the assistant is a design choice and does not represent a real individual.

6.2 Output may be wrong

Responses from the AI assistant are generated automatically and may be inaccurate, incomplete, or out of date. You should not rely on them. Nothing the AI assistant says constitutes financial, insurance, legal, or tax advice, an offer of credit or coverage, a quote, a determination of eligibility, or a commitment of any kind.

6.3 The AI assistant does not bind us

Statements made by the AI assistant do not create any obligation, representation, warranty, or agreement binding on HomeWealthNow or any partner. Where anything the AI assistant says conflicts with these Terms, our Privacy Policy, or the terms of an actual loan or insurance document, those documents control.

6.4 No automated decisions about you

The AI assistant does not make lending decisions, insurance underwriting decisions, or any other decision producing a legal or similarly significant effect concerning you. Those decisions are made by licensed human professionals at our partner lenders and carriers.

6.5 You can always reach a person

You may request a human at any point in a conversation, or call us directly during business hours. You are never required to use the AI assistant to reach us or to receive our services.

6.6 Conversations are recorded

Conversations with the AI assistant are recorded, stored, may be reviewed by our staff, and may be shared with the partner we refer you to. See our Privacy Policy. Do not enter Social Security numbers, account numbers, passwords, or detailed medical information into the chat.

6.7 Acceptable use

You agree not to use the AI assistant to attempt to extract its underlying instructions, to circumvent its limitations, to generate unlawful or abusive content, or to interfere with its operation.

7. Call recording

Calls to and from HomeWealthNow may be monitored or recorded for quality assurance, training, and record-keeping, including maintaining proof of consent. Where required by law, you will be notified at the beginning of the call. If you do not wish to be recorded, tell us and you may end the call or ask to communicate in writing instead. Recordings are retained as described in our Privacy Policy.

8. No financial, insurance, legal, or tax advice

Everything on this Site is general information and education only. It is not, and must not be treated as:

  • Financial advice or a recommendation of any product
  • Insurance advice or a recommendation of any policy or carrier
  • Legal advice
  • Tax advice
  • A substitute for consulting a qualified professional

Before entering into a reverse mortgage or purchasing an insurance policy, consult qualified professionals. For a reverse mortgage, HUD requires an independent counseling session with a HUD-approved agency, and we encourage you to use it fully.

Program rules, FHA limits, interest rates, insurance rates, and product availability change. We do not guarantee that information on the Site is accurate, complete, or current at the time you read it.

9. Third-party lenders, agents, and carriers

Our partners are independent third parties. We do not control them. You acknowledge that:

  • Each partner has its own terms, fees, eligibility criteria, and privacy practices.
  • Any agreement, loan, or policy you enter into is directly between you and that party, not with us.
  • We are not responsible for the acts, omissions, products, services, representations, or advice of any partner.
  • We make no representation that any partner is the best or lowest-cost option available to you.

If a partner does something you believe is improper, tell us and we will look into it. You may also contact your state's regulator: the state banking or mortgage department for a lender, or the state insurance department for an insurance agent or carrier.

10. Prohibited conduct

You agree not to:

  • Provide false, misleading, or another person's information without authorization
  • Impersonate any person or entity
  • Use bots, scrapers, or other automated means to access the Site without our written permission
  • Interfere with, disrupt, or place undue load on the Site or its infrastructure
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to any system or account, or to reverse engineer any part of the Site
  • Use the Site for any unlawful, fraudulent, or unauthorized purpose
  • Harvest or collect information about other users

Violation may result in termination of your access and, where warranted, referral to law enforcement.

11. Intellectual property

All content on the Site, including text, graphics, logos, images, video, audio, software, code, design, layout, trademarks, service marks, and trade names, is owned by HomeWealthNow or our licensors and is protected by copyright, trademark, and other laws.

You may view the Site and download or print one copy of materials for your own personal, non-commercial use, provided you keep all copyright and proprietary notices intact. You may not otherwise copy, reproduce, republish, distribute, publicly display, or create derivative works from our content, or use our trademarks, without our prior written permission.

If you send us feedback or suggestions, you grant us a non-exclusive, royalty-free, perpetual license to use them without obligation to you.

12. Disclaimers and limitation of liability

We make no guarantee regarding whether you will qualify for any product, the rate, premium, coverage, or loan amount you may be offered, the amount of home equity you may access, or the timeline for processing or approval.

Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, gross negligence, or willful misconduct, or for any liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

Nothing in these Terms waives any right you have under a statute that does not permit waiver, including consumer protection statutes.

13. Indemnification

You agree to indemnify, defend, and hold harmless HomeWealthNow and its officers, directors, employees, contractors, agents, and affiliates from any third-party claims, losses, damages, liabilities, and reasonable attorneys' fees arising from your violation of these Terms, your violation of any law or third-party right, information you provided that was false or that you were not authorized to provide, or your misuse of the Site.

This obligation does not apply to the extent a claim arises from our own fraud, gross negligence, or willful misconduct.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. It describes what we collect, how we share it with lending and insurance partners, how AI conversations and call recordings are handled, how long we keep information, and your rights, including your right to opt out of sale or sharing.

15. Third-party links

The Site links to third-party websites, including government and nonprofit consumer resources. We do not control those sites and are not responsible for their content, terms, or privacy practices. Your use of them is at your own risk.

16. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for violation of these Terms, fraudulent or deceptive conduct, or other conduct we reasonably deem harmful. You may stop using the Site at any time.

Provisions that by their nature should survive termination will survive, including Sections 8, 9, 11, 12, 13, 17, 18, and 20.

17. Dispute resolution and arbitration

Read this section carefully

It affects your legal rights. It requires most disputes to be resolved by individual arbitration rather than in court, and waives your right to a jury trial and to participate in a class action. You may opt out within 30 days — see Section 17.6.

17.1 Informal resolution first

Before starting arbitration, you agree to try to resolve the dispute informally. Send us a written Notice of Dispute at [email protected] or to our mailing address, describing the dispute and the relief you want. We will do the same if we have a dispute with you. If the matter is not resolved within 30 days, either party may begin arbitration. This step is a condition of starting arbitration, and the deadline to file any claim is paused while it runs.

17.2 Agreement to arbitrate

Except as stated in Section 17.3, any dispute arising from or relating to these Terms, the Site, or our services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, as modified by these Terms. The arbitrator's decision is final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

17.3 What is excluded from arbitration

This arbitration agreement does not apply to:

  • Small claims court. Either party may bring an individual claim in small claims court if it qualifies under that court's rules.
  • Injunctive relief for intellectual property. Either party may seek injunctive relief in court to protect intellectual property rights.
  • Any claim that applicable law does not permit to be arbitrated.

17.4 Where arbitration takes place, and who pays

You may choose to have the arbitration conducted:

  • In the county where you live;
  • By telephone or video conference;
  • Based only on written submissions, where the AAA rules allow; or
  • In Fulton County, Georgia, if you prefer.

We will not ask you to travel to Georgia. Filing, administrative, and arbitrator fees are governed by the AAA Consumer Arbitration Rules, which cap the amount a consumer pays. We will pay any portion of those fees exceeding the consumer cap, and we will pay your share of the filing fee if you tell us paying it would be a hardship. Each party is responsible for its own attorneys' fees unless the arbitrator awards them under applicable law.

17.5 Class action waiver

Arbitration and any court proceeding permitted under Section 17.3 will be conducted on an individual basis only. Neither party may bring a claim as a plaintiff or class member in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any form of class proceeding.

Blow-up provision: if this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request must be brought in court and severed from arbitration, and the remaining claims will still be arbitrated.

17.6 Your right to opt out

You may opt out of this arbitration agreement, including the class action waiver, by notifying us in writing within 30 days of the date you first accepted these Terms. Send your name, the phone number or email you gave us, and a clear statement that you are opting out of the arbitration agreement, to:

Opting out will not affect your use of the Site or our services in any way, and we will not treat you differently because of it. If you opt out, Section 18 governs where disputes are heard.

17.7 Jury trial waiver

If a dispute proceeds in court rather than arbitration, both you and HomeWealthNow waive any right to a jury trial, to the extent permitted by law.

17.8 Survival

This Section 17 survives termination of these Terms and any termination of your use of the Site.

18. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles, except that the Federal Arbitration Act governs Section 17. Nothing in this section deprives you of the protection of mandatory consumer protection laws of the state where you reside.

Any dispute not subject to arbitration will be brought in the state or federal courts located in Fulton County, Georgia, and you and we consent to the personal jurisdiction of those courts. This does not limit your right to bring a qualifying individual claim in small claims court where you live.

19. Changes to these terms

We may update these Terms. When we do, we will post the revised version with a new "Last updated" date.

For material changes, we will provide at least 30 days' notice before they take effect, by posting a prominent notice on the Site and, where we have your email address, by email. Material changes will not apply retroactively to a dispute that arose before the change.

Your continued use of the Site after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Site and contact us to have your information removed.

20. General provisions

20.1 Severability

If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions will stay in full force.

20.2 No waiver

Our failure to enforce any provision is not a waiver of our right to enforce it later.

20.3 Assignment

You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets, on notice to you.

20.4 Entire agreement

These Terms and our Privacy Policy are the entire agreement between you and HomeWealthNow regarding the Site and supersede prior agreements on that subject. They do not govern any loan or insurance contract you enter into with a partner; those are governed by their own documents.

20.5 Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control.

20.6 Acknowledgment

By using this Site or submitting information through our forms, you acknowledge that you have read and understood these Terms, that you agree to be bound by them, that you have the legal capacity to do so, that HomeWealthNow is not a lender or an insurance company and does not provide financial, insurance, legal, or tax advice, that our website chat assistant is AI software and not a person, and that you consent to being contacted as described in Section 5.
